Expiration of Term of Office for Herkimer County Community College Trustees

POLICY STATEMENT:  Upon expiration of a Trustee’s term, each Trustee may continue to serve in his/her position, as a “holdover”, until his/her successor is appointed and qualified.  This allows the Board of Trustees to continue operating and conduct business.  A holdover does not guarantee reappointment to the Board of Trustees. 

BACKGROUND:  According to Public Officers Law Section 5, “Holding over after expiration of term,” Public Officers, i.e., Trustees, may “hold over and continue to discharge the duties of his office after the expiration of the term for which he shall have been chosen, until his successor shall be chosen and qualified.”
